Patentability / Novelty Search

This is also referred to as a Prior Art Search. This search is done before filing a patent application to check whether inventive features of the Client’s invention have already been disclosed before in one or more published documents. This helps ensure that Clients do not waste resources filing applications for inventions that are already known.

We customize the search based on Client requirements – e.g., Databases to search, Level of detail, Keyword/ Classification based search, What Prior Art Bibliographic information is required, and Whether a Patentability Opinion is required.

State of the Art Search / Patent Landscape Search

This type of search is designed to give the Client an idea about the past and current developments in a particular technology area of interest. This helps the Client decide whether to invest resources into research and other activities in that technology area.

The Report is customized as per Client requirements.

Infringement / Freedom to Operate Search

This type of search is conducted to check whether implementation of the Client’s invention will lead to infringement of others’ patents / patent applications (i.e., blocking patents). This search should be done before the Client commits resources to develop, produce and launch a new product in the market.

While doing this search certain limitations of patents need to be kept in mind – i.e., Patents are valid within certain territories, have a limited duration, and their scope is limited by their Claims.

Validity / Invalidity Search

This type of search is carried out to determine whether an existing patent is valid in view of prior art that was already published as of the priority/ filing date of the patent application. This type of search may be initiated by a patent owner or an alleged infringer to locate anticipatory prior art that might have been overlooked in earlier searches.
